1. Who we are and what these terms cover
The themo-wp.com website is published by Themo WP ("we"). These terms of sale (the "terms") apply to every license ordered on this site for our WordPress products, including the Themo Landin plugin (the "product"), by any person or business ("you").
By placing an order, you accept these terms, our refund policy and our privacy policy. The version that applies to an order is the one in force when you place it.
Our products are aimed first at professionals. If you buy as a consumer, you also keep every right the law gives you, in particular under Moroccan law No. 31-08 on consumer protection measures: nothing in these terms limits them.
2. The product and what a license includes
- Themo Landin is a WordPress plugin for building sales pages and order forms, especially for cash-on-delivery selling.
- Its code is distributed under the GNU GPL license. That license lets you use, study, change and redistribute the copies you receive, with no limit on time or number of sites.
- What we sell is a one-year service license that entitles you, for the number of production sites in the plan you chose (1 site, 5 sites or unlimited sites, as offered):
- to the plugin's updates and their download, from your account or directly in WordPress;
- to the support described in section 8.
- Up to 5 recognised local and staging addresses don't count towards that limit: localhost, private IP addresses, .local or .test domains, staging., stage., dev. or test. subdomains, and the staging addresses of major hosts.
- You may activate your key on your own sites or on your clients' sites, within your plan. You may not sell, publish or share it beyond that limit.
- The Themo name, the logos, the website, the documentation and the visuals are not covered by the GPL (section 12).
3. Your account
- You need an account to buy and manage licenses. It is created with your first order or from the sign-up page.
- You provide accurate information: your name as it should appear on the invoice, an email address you read, and a phone number where we can reach you about your orders.
- You keep your sign-in details confidential and tell us without delay if you think someone else has used them.
- An account belongs to whoever controls its email address. If an account was opened with your address without your consent, choose "I didn't create this account" when you confirm the address from your inbox: every other session ends, the password chosen when it was created is removed, and the account becomes yours.
4. Ordering and when the contract is formed
- To order, you choose a plan, fill in the order form, choose the account you will pay into, accept these terms, then click "Place order". Before placing it, you can check and correct every detail; the summary of the product, plan and price stays on screen next to the form.
- We confirm the order by email, and it appears in your account with the payment instructions. While it is unpaid, you can cancel it from your account; it expires on its own after 7 days.
- The contract of sale is formed when we confirm your payment and deliver the license. We may refuse an order for a legitimate reason, such as suspected fraud or an earlier unresolved dispute; any amount already received is then refunded.
- Your orders, invoices and payment history are archived and remain available in your account, in line with Moroccan law No. 53-05 on the electronic exchange of legal data.
5. Prices
- Prices are shown in US dollars (USD), per year, on the pricing page and during checkout. The price shown when you order is the total you pay: no tax is added to it.
- For a transfer to our bank account in Morocco, the amount is shown in dirhams (MAD), calculated at the exchange rate displayed when you order. That amount is fixed on the order.
- Fees charged by your bank or payment service are yours to bear.
- We may change our prices at any time; a change never affects an order already placed. A renewal costs the price shown on the renewal page when you order it.
6. Payment
- Payment is currently by transfer: Wise, Payoneer, or a transfer to our bank account in Morocco. The account details and the order reference (for example TW-7K3F9Q) are shown in your account; put that reference in the transfer description.
- After the transfer, send the receipt from the order page. We check that the funds have arrived; if the receipt doesn't let us confirm it, we tell you why and the order stays awaiting payment.
- If the amount received is less than the amount due, we may ask you to complete the payment before delivering the license.
- Other payment methods, such as cards or PayPal, may be offered; their terms will then be shown during checkout.
7. Delivery
- As soon as we have confirmed the payment, the license is delivered: the key appears in your account, you receive it by email, and you can download the plugin. The invoice is made available in your account.
- A transfer can take several business days to arrive; the license is delivered as soon as possible after it does.
8. Support
- Support covers installing, setting up and using the product, and fixing reproducible defects. We provide it by email or WhatsApp, through the contacts shown in your account, in French, Arabic or English, on business days and as soon as possible.
- It doesn't include custom development, building your pages, hosting, or problems caused by other plugins, themes or services, although we try to help where we can.
- The product works with WordPress 6.6 or later and PHP 8.1 or later.
9. Term, renewal and expiry
- A license runs for one year from its delivery.
- You can renew it from your account from 30 days before it expires, and at any time afterwards; your account tells you when renewal is open. A renewal extends the license by one year from its expiry date, or from the renewal date if it has already expired. A license paid by transfer doesn't renew automatically.
- When a license expires, the plugin keeps working on your sites. Updates and support stay available for a 14-day grace period, then stop until you renew.
10. Withdrawal and refunds
- If you are a consumer, you can withdraw without giving a reason within 14 days of the license's delivery, even if you have already activated it, and get a full refund. That period goes beyond the 7 days set by Moroccan law No. 31-08.
- For a business purchase, you get a full refund if you ask within 14 days of delivery and the license hasn't been activated on any production site.

11. Suspending and ending a license
- We may deactivate a license when it is refunded, when the payment is reversed or disputed, in case of fraud, or when the key is shared or used beyond the plan and the situation isn't corrected after we have told you. Updates and support then stop; the code already installed remains usable under the GPL.
- You can stop using our services at any time and ask us to delete your account (see the privacy policy). Outside the refund policy, the current license period isn't refunded.
12. Intellectual property
- The plugin's code is distributed under the GNU GPL license: you keep every right that license gives you over the copies you receive. If you redistribute the code, do so under the same license and without using our trademarks to name your version.
- The Themo trademark, our names and logos, the themo-wp.com website, its documentation, texts and visuals are protected. You may not use them to present a product or service as ours, or to suggest a connection with us, without our written consent.
13. Your use of the product
- You remain responsible for your sites, content, products and sales, and for complying with the laws that apply to your business: consumer protection, personal data, advertising, e-commerce and tax.
- What your customers type into Themo Landin's forms is stored on your site, not with us. You are responsible for processing and protecting it.
- You agree not to use the product for unlawful activity, not to bypass license checks or the site limit, not to disrupt our servers (abusive requests, intrusion attempts), and not to sell or hand out license keys.
14. Warranties and liability
- We provide the product with care and, while the license runs, fix reproducible defects that stop it from working as described. We don't promise it is free of every error, compatible with every theme, plugin or host, or that it will produce any particular commercial result.
- Back up your sites before every update.
- To the extent the law allows, our liability is limited to direct damage and to the amount you paid for the license concerned in the last twelve months. We are not liable for indirect damage, such as lost revenue, customers or data.
- These limits don't apply in case of gross negligence or fraud on our part, or to rights the law doesn't allow to be waived, in particular consumers' rights.
15. Force majeure
Neither you nor we are liable for a failure caused by an event reasonably beyond our control, such as a general internet or hosting outage, a natural disaster or a decision by an authority. Performance resumes as soon as the event ends.
16. Changes to these terms
We may update these terms; the date of the last update is shown at the top of the page. New terms apply to orders and renewals placed after they are published. If an important change affects a running license, we tell you by email.
17. Personal data
We process your data as described in our privacy policy.
18. Language, governing law and disputes
- These terms are offered in French, Arabic and English. If the versions differ, the French version prevails.
- They are governed by the law of the State of Wyoming (United States), where Themo WP is registered, without prejudice to the mandatory rules that protect consumers in their country of residence.
- If we disagree, write to us first: we look for an amicable solution for 30 days. Failing that, the dispute goes to the competent courts of the State of Wyoming, subject to mandatory rules that let a consumer go to the court where they live.
